TERMS AND CONDITIONS OF SALES AND DELIVERY
§ 1 TERROTORY
All business between "Ulf Jantzen (Rechtsform?) and our customers is governed by these "TERM AND CONDITIONS OF SALES AND DELIVERY". The customers acknowledges these "TERM AND CONDITIONS OF SALES AND DELIVERY" by submitting his order by mail,by electronic mail, by use of the online order form or by telefax to our business adress. All business relations are based on German Law.
§ 2 ORDERING AND ORDER CANCELLATION
Ulf Jantzen (Rechtsform) is not bound to orders based upon errors on the website and has the right to cancel an order based upon errors on the webpage. This applies also to products, which are no longer available at the time of order. Ulf Jantzen reserved the right to cancel orders at any time. Delivery times are approximate and not contractually binding.
§ 3 PRICES AND PAYMENT CONDITIONS
19% Value Added Tax (Sales tax) are included in the product prices. A deposit of 30% of the final quoted product price is required at the time of order. If work has begun on the bow, the deposit is non-refundable if the order is then cancelled by the customer.
§ 4 BALANCE OF PAYMENT
Products will be shipped after full balance of product price and shipping costs are received. Full balance must be received within 30 days of notice of completion on custom bows. If
§ 5 SHIPPING AND HANDLING COSTS
Shipping and handling costs are quoted before the final balance is due and must be paid with balance of product price. This applies to return shipments prior authorized by the bowyer.
§ 6 WARRANTY/REPAIRS/LIABILITY
There is a 24 month warranty on materials and workmanship on the bow beginning with the date on the invoice. Bow strings, arrow rests,strike plates and bow finish are excluded from the warranty. The warranty covers materials, glue lines and the basic functions of the bow. The applicable portions of German Law remain untouched.
Minimal loss of draw weight is not covered by the warranty. Damage to the glass caused by falls on hard ground or rough handling is not covered by the warranty. Difference in color, texture and size from the procucts shown on this webpage are possible. These differences are considered normal working with natural materials and man made materials supplied by others and prohibit return, exchange or lowering of sale price as long the basic functionality of the product is not inhibited. Differences in wood grain compared to the photos on the webpage are also deemed normal in working with natural materials. We are not liable for damage to the product, bodily injuries to persons or property damage caused by the improper use of the product. Bow breakage, delamination and deformation due to strung storage in high heat environments are excluded from the warranty. Don't laeve your strung bow in vehicles exposed to the sun! Let your bow cool before stringing after unstrung storage in heated vehicle. The bows are made to the customers specifications. All bows are tested one inch further than the stated maximum allowable draw length on the bow prior to delivery of the bow. Bow failure caused by overdrawing the bow over the stated draw length on the bow are not covered by the warranty. Damage due to improper stringing without the use of a bow stringer is not covered. Always use a bow stringer for stringing a recurve bow! If you don't know how to use the bowstringer properly, please call me before trying on your own! Return shipping for justified returns will be refunded after thorough examination of the product. The acknowledgment of a warranty claim and the technical examination will be done solely by the bowyer.
§ 7 RETURNS
Custom bows are excluded from returns unless the product differs greatly from the customer's order. Draw weight differences of +/- 2 pounds (lbs) at the stated draw length are normal and no reason for a return. Differences in bow length or string length are no reason for returns,if the function of the bow in relation to the ordered draw length is not inhibited. Streaks in clear glass are no reason for a return/ warranty claim if it doesn't inhibit function. Returns because of "aestetic personal dislike" of the product is excluded. For individual custom products, the German Mail Order Law (Fernhandelabsatzgesetzes) does not apply. No exclusions!
§ 8 PLACE OF FULLFILMENT AND PLACE OF JURISDICATION
Place of fullfilment and place of jurisdication is the city of HEMER/GERMANY.
§ 9 SALVATORIOUS CLAUSE
If certain regulations of these TERMS AND CONDITIONS OF SALES AND DELIVERY are erroneous or uneffective, the remaining parts of these TERMS AND CONDITIONS OF SALES AND DELIVERY remain unchanged. Eventual voids in these TERMS AND CONDITIONS OF SALES AND DELIVERY may be filled by applicable portions of the German Laws.
